Chapter 13 Filing

     Chapter 13 is a proceeding in the United States Bankruptcy Court, but it is not a bankruptcy. It is a dignified honorable way of paying your debts.

     Federal law provides for Chapter 13. A method of stopping the foreclosure sale of your home or the repossession of your automobile. It also stops wage garnishments or tax levies, and all other actions by your creditors to seize your money or property.

     It allows you to structure an orderly payment plan which may last up to five years to re-pay your creditors in full. If you cannot afford to 100% of your debt, you may pay a lesser percentage with the unpaid balance discharged or “wipe-out” upon the successful completion of your plan.

     If you are behind on your home mortgage payments, Chapter 13 allows you to put the past due payments in the plan and begin making current home mortgage payments directly to your mortgage company. In some situations, the second mortgage or equity line on your residence, may also be removed. If your automobile has been repossessed, Chapter 13 may allow you to get it back prior to its sale by the bank.

     If taxing authorities are levying your paycheck. Chapter 13 can stop it. If utility companies are threatening to turn you off or have already done so, Chapter 13 can get your utilities turned back on and keep them on. If creditors are driving you crazy with phone calls and bothersome letters, Chapter 13 can stop it. Filing a Chapter 13 payment plan creates an immediate protective order over you that stops all creditors from contacting you or from taking any further action to collect their debt. It allows you to structure a payment plan suited to your needs and your budget.
